Terms of Use

1.1 These Terms of Use govern your access to and use of https://jinx.design and its subpages and subdomains (the “Website”). By using the Website, you accept these Terms.

1.2 The Website is operated by Jinx Design Studio, a registered small business operating under the Individual Entrepreneur regime in the Republic of Georgia. You can contact us at hey@jinx.design.

1.3 If you purchase or subscribe to our design services, those services are governed by the Subscription Offer Agreement. If these Terms conflict with the Subscription Offer Agreement, the Subscription Offer Agreement controls  the subscribed services.

1.4 This Terms may be updated from time to time to reflect legal, technical, or business changes. The most current version is always available at https://www.jinx.design/docs/usage, as indicated by the “Last updated” date. If any changes are material, we will take reasonable steps to notify you in advance.

2.1 You may use the Website only if you are at least sixteen years old and have the capacity to enter into a binding agreement or if you are supervised by a parent or legal guardian. You agree to use the Website lawfully and in a manner that does not infringe the rights of Jinx or any third party and does not restrict or inhibit anyone else’s use of the Website.

2.2 You shall not interfere with or disrupt the Website or servers. Attempt to probe, scan, or test the vulnerability of any system or network, circumvent any security or authentication measures, use any robot, spider, scraper, or other automated means to access the Website for any purpose without our prior written permission, or upload or transmit any malicious code.

2.3 The content on the Website is for general information only and does not constitute legal, financial, medical, or other professional advice. You should obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content.

3.1 The Website is hosted on Webflow. If you book a call, scheduling is provided via Cal.com. Email communications are handled via Proton Mail. When you complete a payment through a link we provide, the payment is processed by BoomFi (boomfi.xyz). Each provider processes data under its own terms and privacy notices. We do not control third-party sites and services and are not responsible for their content, policies, or practices.

3.2 Our Privacy Policy explains how we process personal data when you visit the Website or communicate with us. By using the Website, you acknowledge our processing as described there. We use strictly necessary cookies to run core site features and, only with your consent, Google Analytics 4 for analytics. Analytics stays blocked until you consent, and you can withdraw your choice at any time via the cookie banner or in your browser.

4.1 The Website and all content on it, including text, graphics, logos, illustrations, and layouts, are owned by Jinx or our licensors and are protected by applicable intellectual property laws. You may view the Website and, where technically enabled, make a temporary copy for the purpose of viewing, but you may not copy, modify, translate, adapt, reverse engineer, decompile, disassemble, publish, broadcast, sell, license, or otherwise exploit any part of the Website or its content, except as permitted by law or with our prior written permission.

4.2 If you send us comments, ideas, or suggestions, you grant Jinx a non-exclusive, worldwide, royalty-free license to use and incorporate them into our Website and services without obligation to you.

5.1 We may change, suspend, or discontinue any part of the Website at any time without notice, and we do not guarantee that the Website or any content will always be available or be uninterrupted. The Website and its content are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the extent permitted by law.

5.2 To the extent permitted by law, Jinx’s total liability for all claims arising out of or related to the Website will not exceed one hundred U.S. dollars (USD 100) or, if higher, the amount you actually paid to us in the twelve months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

5.3 You agree to indemnify and hold harmless Jinx and our directors, employees, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your use of the Website or your violation of these Terms.

6.1 These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter are governed by the laws of Georgia. The courts of Georgia have exclusive jurisdiction, and venue will lie in the competent courts of Tbilisi, Georgia. Mandatory consumer protections available under your local law remain unaffected if you are a consumer resident in the EEA or the UK.

6.2 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. A failure to enforce any provision is not a waiver of future enforcement of that or any other provision. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign our rights and obligations to an affiliate or a successor in interest. These Terms constitute the entire agreement between you and Jinx regarding your use of the Website and supersede any prior agreements on the same subject.
